Tow operators and tow truck drivers must follow the requirements of the Towing and Storage Safety and Enforcement Act, 2021. This Act sets out:- Responsibilities for operating a tow truck.
- Rules for conduct toward the public and at accident scenes.
- Maximum rates that can be charged for towing services.
- Your rights when requesting or receiving towing services.
Your Rights
You have the right to:- Decide who can tow your vehicle and where it will be taken.
- Receive and review the Consent to Tow form and the Maximum Rate Schedule before towing begins — never sign a blank form.
- Receive an unaltered copy of the signed Consent to Tow form.
- Obtain an itemized invoice before paying and receive a receipt upon payment.
- Choose your payment method.
- Contact the Ministry of Transportation if you have concerns about the services you receive or the conduct of a tow truck driver or operator.
Tow Operator Responsibilities
Tow truck drivers and operators must:- Notify you if your vehicle is taken to a location different from the one you identified.
- Not charge more than the published maximum rates set by the Government of Ontario.
- Accept multiple forms of payment.
- Not pressure you into consenting to additional services, such as vehicle storage.
- Not refer you to medical or legal services, and only refer you to another towing, storage, or repair business if you request it.
- Disclose any financial interest or benefit from a referral at the time it is made.
Identification & Code of Conduct
- Tow operators are identified by name and certificate number on both the Consent to Tow form and the tow truck. Always confirm that these match.
- Tow truck drivers and operators are subject to a Code of Conduct under the Act. For more details, visit the Government of Ontario’s official website.
